TERMS

These Terms of Use (the “Terms”) govern NEIROA (the “App”). By using the App, you agree to these Terms.

Where applicable law requires it, a minor must obtain a parent or legal guardian’s consent.

The App uses on-device AI models to generate audio and related information. Models, features, performance, and how they are provided may be added, changed, or removed in updates. Future features or models may have extra conditions, which will be shown before you use them.

Subject to applicable law, these Terms, and third-party conditions that apply to you, you may use, export, share, commercially use, and sell audio you generate in the App.

MONOFRAME does not warrant that copyright or other rights arise in generated works, that you receive exclusive rights, that the output does not infringe third-party rights, that it fits a particular purpose, or that it meets a quality you expect. You are responsible for reviewing output and deciding how to use it.

You must not use the App, an AI model, or its output in any of the following ways.

• Using the App, an AI model, or its output to commit, assist, or promote illegal, criminal, dangerous, or malicious activity, including unlawful goods or services, violent extremism, or terrorism.
• Infringing, misusing, or misappropriating copyright, trademark, publicity, privacy, or other third-party rights.
• Creating, promoting, or facilitating child sexual abuse or exploitation, hate, harassment, bullying, violence, self-harm, discrimination, or harm to a person.
• Tracking or monitoring a person without consent, or generating, collecting, processing, or inferring personal, sensitive, or private information without a lawful basis.
• Using the App for fraud, phishing, malware, spam, impersonation, false origin, misinformation, misleading claims, or defamation.
• Providing legal, medical, accounting, financial, or other professional services without required qualifications, or using the App for automated decisions that materially affect rights or welfare.
• Bypassing, or attempting to bypass, safety features.
• Generating pornographic or other sexually explicit content for sexual gratification, except for lawful scientific, educational, documentary, or artistic purposes.
• Violating Gemma Terms of Use Section 3.2 or the Gemma Prohibited Use Policy.
• Violating the Stability AI Community License, applicable Stability AI terms, or the Stability AI Acceptable Use Policy.
• Interfering with the App, gaining unauthorized access, or using an AI model to create or improve a foundational generative AI model except where the applicable terms expressly allow it.

The App, its code, interface, design, names, marks, and other MONOFRAME or NEIROA brand materials remain MONOFRAME’s (or its licensors’) property. You may not copy, redistribute, or create derivative works of those materials without permission, except as allowed by law or by a license that applies to a specific open-source component.

Generated audio, track information, playlists, and similar data are stored primarily on your device. Hardware failure, low storage, OS or App updates, deletion, reset, or mistakes can cause loss. MONOFRAME does not warrant permanent storage, recovery, or backup. Export and back up audio you need to keep.

Purchases, payment, refunds, and restore are handled through Apple’s App Store and your Apple Account, under Apple’s terms and procedures. Reflecting purchase state may require a connection to the App Store.

MONOFRAME may change, limit, interrupt, or end all or part of the App when needed for maintenance, faults, law or rights issues, changes to model-provider terms, or similar reasons. Features and AI models may change or end.

The App and generated output are provided as is. MONOFRAME does not warrant accuracy, completeness, continuity, security, merchantability, fitness for a particular purpose, non-infringement, generation quality, or freedom from errors. Where consumer-protection or other mandatory law forbids a disclaimer, that law controls to that extent.

Except for MONOFRAME’s willful misconduct or gross negligence, or other cases where law does not allow a disclaimer, MONOFRAME is not liable for damage from use or inability to use the App, data loss, or use of generated output. Where MONOFRAME is liable, and law allows a limit, liability is limited to ordinary, direct damages, and to the amount you actually paid for the App in the preceding twelve months. Mandatory consumer law prevails where it applies.

MONOFRAME may change these Terms when reasonably needed, including for law, features, or models. Material changes will be noted in the App or another suitable place. Continued use after a change means you accept the updated Terms, unless law requires a different process.

These Terms are governed by the laws of Japan. Unless law requires otherwise, the Japanese court with jurisdiction over MONOFRAME’s location is the exclusive court of first instance for disputes about the App or these Terms.
